Toyoda Gosei Co., Ltd. (Head Office: Haruhi-cho, Nishikasugai-gun,
Aichi-ken, Japan, President: Mr. Takashi Matsuura) and Nichia Corporation
(Head Office: Anan-shi, Tokushima-ken, Japan, President: Mr. Eiji Ogawa)
previously announced on start of settlement negotiation (August 9, 2002)
concerning technology of nitride semiconductors such as blue LED, to
respect any and all patent rights etc. which the other party owns and
to enter into negotiations in good faith in order to come to an end
of any and all disputes and suits in and outside Japan between the parties
which lasted for several years. Thereafter, as a result of both parties'
negotiations in good faith, the negotiation with respect to the contents
of the Settlement Agreement has been completed and the execution thereof
is expected to be made on September 17. Please note that this announcement
is to avoid selective disclosure in the light of the statement given
at about 13:40, today (September 5) in the open trial at the Osaka District
Court (Judge: Kazuo Komatsu as Presiding Judge) by one of Nichia Corporation's
attorneys to the effect that the settlement negotiation had been concluded
and that the Settlement Agreement would likely be executed on September
17. Also, please note that we are unable to respond to any inquiry about
the contents of the Settlement Agreement.
